YOUR ROLE AS PROPERTY MANAGER
Your participation is central.
For the test used in this approach, your qualifying participation totals more than 100 hours per tax year and is at least as much as any other individual’s.
You set guest acceptance criteria, make operating decisions and handle administrative coordination. AI records participation from activity evidence; you review, correct and approve the record. Your CPA confirms which work counts.
Actual work determines the result. Your CPA reviews the evidence and confirms whether you meet the applicable test.

More than an hours log.
We produce the comparison—including our own.
Our mandatory participation registry covers everyone working on the property, on site or remotely. One ledger captures each person’s name, role, tasks, dates, actual time and supporting evidence. You review and approve your AI-recorded entries.
AIstat’s routine work is performed by AI software. A task needing human involvement goes to a named AIstat team member; their time appears alongside every contractor’s in your comparison.
The same annual planning cap applies to each contractor and AIstat team member: below 100 hours per tax year and never more than your qualifying participation. We check time against the agreed scope before assigning work and flag a potential breach for review. Actual hours, including any overrun, are always reported in full.
Your spouse’s qualifying participation counts with yours toward material participation under §469(h)(5)—two people’s work toward the same test.
Software activity is not human participation. The comparison is by individual across all their roles, with qualifying spouse participation included in the owner total; planned limits do not replace your CPA’s assessment of actual work.

AIstat prepares owner and contractor agreements with defined scopes of work, expected participation, reporting requirements and approval boundaries. The scopes preserve your authority as property manager; your legal adviser reviews the actual contracts.
Contractors are optional, à la carte additions. Our disclosed fee covers contractor participation oversight and scope-of-work agreements. You remain the property manager and retain administrative coordination, operating decisions and approvals.
